TERMS & CONDITIONS

JT Biokinetics aims to deliver a caring, professional and individual service to its clients and our Terms and Conditions are to help you understand how we operate our practice. By commencing your therapy, you are deemed to have acknowledged and have agreed to be bound by these Terms & Conditions.

1.   The Agreement

​

This agreement is between the patient (referred to as ‘you’, ‘your’ and “client”) and JT Biokinetics Ltd (referred to as ‘JT Biokinetics’, ‘we’ or ‘us’). Where a person as a parent or guardian arranges treatment on behalf of another under their care, they agree that they will be bound by these Terms. In these circumstances, the references in these Terms to ‘you’ and ‘your’ shall include, as well as the client, the parent or guardian.

Please read these terms carefully. They provide the basis on which you will receive services from JT Biokinetics and its staff, contractors and service providers.

JT Biokinetics may update these terms from time to time and you will be notified of any changes that come into effect via one of the following methods:

  • in person when visiting the clinic

  • via notifications on our website

  • via notices within the clinic

  • via email to the address that we hold for you (it is the patient’s responsibility to ensure that the address that we hold for you is correct).

Terms & Conditions will not be posted to you unless this is specifically requested in writing.

2.   Initial Consultation and Therapy Sessions

 

  1. We will normally provide you with Therapy Sessions only after an Initial Consultation has been carried out. If there is a significant period between an Initial Consultation and us providing the Therapy Sessions, we may ask you to confirm in writing that the Initial Consultation remains accurate or ask you to undergo another Initial Consultation.

  2. Unless with the express agreement of J T Biokinetics, Therapy Session Packages should be completed within a reasonable period and no longer than three months from their commencement date. For packages with 8 or less sessions, this time period may differ so please confirm with JT Biokinetics before ordering. Packages with 5 or less sessions should be completed within 4 weeks of their commencement date. No refunds will be offered for unused sessions outside of this time frame.

  3. Sessions are not transferable to others as they are recommended and based on your personal initial assessment..

 

3.   Fees and Payment:

 

  1. Fees for each consultation and therapy session are confirmed by us to you and are payable in advance or at the end of each consultation/therapy session.

  2. Fees for Therapy Sessions Programmes are confirmed by us to you and payable in advance or in accordance with terms of the invoice issued prior to the commencement of the Programme.

  3. We accept payment by cash, cheque and most credit cards. Payment by bank transfer (BACS) may also be accepted on request. Payment always remains your responsibility and you will be liable for any outstanding sums unpaid by you, your insurer or your referrer.

  4. In the event of non-payment by the end of the consultation or therapy session you will be sent an invoice reminder.

  5. For accounts outstanding for more than seven days following a consultation or therapy session we reserve the right to charge a reasonable administration fee. Failure to settle your account in full or to respond to subsequent invoice reminders may lead to additional administrative charges.

  6. Payment is due for your session(s) before or on the date of your session with us. Packages should be paid in full (or the first instalment if paying by instalments) before your first follow up session. 

  7. If payment is not received on/before the date of your first session with us, admin and late payment fee charges will be added to your invoice once the invoice reaches 7 days overdue. This fee is currently £25.00 per week overdue, however this amount is subject to change.

4.   Cancellation and Late Arrival

 

  1. If you have booked a consultation or therapy session and you cancel with less than 24 hours' notice (48 hours over weekends) or do not turn up for the consultation or session, then you are liable to pay the cost of that consultation or therapy session.

  2. If you are late arriving at a consultation or therapy session, the consultation or therapy session will begin on your arrival and continue until the time when it is scheduled to end. If you wish the consultation or therapy session to overrun, and we agree, then you may be charged at our discretion for the extra time we spend in providing these services.

  3. On occasion, we may have to cancel a scheduled consultation or therapy session where, for example, a staff member is sick or a preceding consultation or therapy session has overrun. If we must cancel a scheduled consultation or therapy session, we will book you another appointment as soon as reasonably possible. No charge will be made to you for the consultation or therapy session cancelled by us.

  4. For terms relating to unused therapy session packages, please see section 2 of these terms and conditions.

  5. Sessions are not transferable to others.

 

5.   Medicines and Contra Indications

 

  1. JT Biokinetics must be advised prior to the commencement of any therapy about any chronic medications, heart pacemakers or other medical devices that could be contra indications to treatment or the use of muscle stimulators.

  2. JT Biokinetics does not accept any responsibility for conditions arising from undeclared medications or medical devices.

 

6.   Outcomes

​

We shall seek to enable you to achieve your desired outcomes. No outcome can be guaranteed, however, and you have sole responsibility for acting on any recommendations or advice we may give. We have no liability for any loss incurred by you, whether financial or otherwise, following the provision of therapy, nor for any perceived failure by you, whether justified or otherwise, to achieve your desired outcomes or goals.

7.   Confidentiality

 

  1. JT Biokinetics may require personal information from an individual to support their therapy or to collect appropriate information to handle their enquiry.

  2. Personal information may include name, date of birth, address, email address, contact number, source of referral and brief detail of their condition requiring biokinetic therapy.

  3. We shall treat all personal and business information supplied by you as confidential. We shall not disclose such information to any third party without your prior permission, except where required by law or where action might be necessary to protect you or someone else.

  4. When an individual discloses personal information about themselves verbally, or in writing, they consent to our use of the information for therapy purposes. This information is held and used in compliance with the Data Protection Act 2018.

  5. We will request permission to share specific information with regards to your treatment, medication or condition when referring you to, for example, another medical practitioner or consultant for further or extra treatment.

  6. We will however divulge confidential information to Social Services if there are any concerns that you, the child in your care or a vulnerable adult in your care is being harmed or abused in any way, including grooming or Female Genital Mutilation etc.

  7. Specific exercise videos taken by JT Biokinetics will be used for reporting progress or for assisting others with rehabilitation or remediation. You may not share any videos you receive for this purpose with anyone for any reason.

 

8.   Child Protection, Safeguarding & Prevent Duty

​

As responsible British Citizens, our duty is to ensure the safety and welfare of all children in our area of care in line with the procedures laid out by the local Safeguarding Children’s Board. This includes protecting children at risk of radicalisation from their families, from outsiders or casual passers-by.

 

  1. The only photographs allowed are for record keeping and will have been discussed with you. They are never distributed to a third party or a public domain for any reason at all.

  2. Biokineticists routinely bruise soft tissue during therapy.  Photos of any existing bruises or injuries will be taken and stored to create a base record before any biokinetic therapy.

  3. JT Biokinetics are aware of the signs and symptoms of child abuse, physical, emotional and sexual, and those of neglect. We will be on the lookout for signs of radicalisation or grooming of any sort. If we have reason to believe that any child in our care is being abused or radicalised in any way, we will report the matter to the Surrey Council Safeguarding Coordinator, or to Channel (radicalisation). Under these circumstances we will not be able to keep information relating to this child confidential but will need to share it with Social Services and the Police if requested.

 

9.   Chaperone for a Minor Person during Therapy

​

By law, anyone under the age of 18 is considered a minor and to commence therapy with a minor JT Biokinetics requires either:

  1. a chaperone during therapy, or

  2. specific signed permission granted by the responsible adult for that minor before therapy can proceed.

 

10.  Your Property

​

Whilst we will take all reasonable care to ensure the safety of your belongings, JT Biokinetics does not accept any responsibility for the theft or loss of, or damage to, any of your or your accompanying party’s property.

​

11.  Contact Details

​

It is important that you keep us updated of any changes in your contact details. We cannot be held liable should you fail to update us regarding any changes to your contact details including name, mailing address, telephone numbers or email address.

12.  Data Protection

​

We are registered under the Data Protection Act 2018 and we shall treat all personal data in accordance with the requirements of that Act.

​

13.  Limitation of Liability

 

  1. Our liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount (and not exceeding the amount you pay in total for the Services), having regard to such factors as whether the damage was due to a negligent act or omission by JT Biokinetics.

  2. Nothing in these conditions will limit our liability for death or personal injury caused by our negligence or the negligence or our employees, agents or subcontractors or fraud and fraudulent misrepresentation.

  3. We shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, or for any loss of profit, or for any indirect or consequential loss arising under or in connection with our therapy services. Except as set out in these conditions, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the contract. This clause will survive the termination of the contract.

  4. We will not be liable to you as a result of any delay or failure to perform our obligations under this contract as a result of any event beyond our control including but not limited to, strikes, lock-outs or other industrial disputes, failure of a utility service or transport network, act of God, fire, flood or storm or breakdown of machinery.

 

14.  Indemnity

​

You agree that you will indemnify us against any and all loss or damage suffered, including any legal fees or costs, as a result of any breach of this agreement by you.

​

15.  Variation

​

We may change any of these terms or conditions, including our fees, at any time.

​

16. Law

 

  1. If any of these conditions shall be found to be unenforceable it shall not affect the validity or enforceability of the remainder of the conditions.

  2. This agreement is governed and construed by English law and the parties submit to the jurisdiction of the courts of England and Wales.
